IMMIGRATION APPEALS

Has the Department of Homeland Security ordered you removed from the US, denied your asylum petition, rejected your Green Card application, or denied a visa application?  If you believe that the Immigration Court made a serious legal mistake in your case, or there are new facts that may help your application, you may have the right to appeal the unfavorable decision and receive a different and more successful result. Time is short, however:  if the Immigration Court has ordered you to leave the United States, you only have thirty days to file an appeal with the Board of Immigration Appeals.  If the removal order is from the Board of Immigration Appeals, you only have thirty days to file a Petition for Review with the Second Circuit Court of Appeals.  Don't delay!  It is entirely possible that an appeal will help you get a more favorable decision.   

ARTICLE 78 APPEALS

Were you fired from your government position without due process of law?  Were you unfairly turned down for government benefits, or did you receive an unfavorable decision from a government administrative agency such as the State Liquor Authority, Unemployment Insurance Appeals Board, or Housing Authority?  You have the right to appeal unfair administrative decisions under Article 78 of the CPLR.  Again, the time to file your administrative appeal is short - usually only ninety days from the date of the decision.  Don't delay!  If you feel you have a possible case, contact us immediately for a FREE evaluation of your situation.  It may be that an Article 78 appeal will result in a reversal of the unfavorable administrative decision.

CIVIL APPEALS

Whether you are a plaintiff or a defendant, if a trial court issues an unfavorable decision, you probably have the right to appeal it.  As with other appeals, time is short, and in most cases you have no more than thirty days to appeal the decision.  What are your chances of winning an appeal?  It depends - if the trial court made no obvious errors of fact or law, there is not much chance that the appellate court is going to overturn the decision.  On the other hand, if it seems clear that the trial court made a significant error of law, or did not take into account important facts, then an appeal is worth considering.  The time to appeal most civil court rulings is thirty days, so don't delay in contacting us for a FREE evaluation of your case.

COSTS

Most lawyers are not willing to advertise their prices, and for good reason:  they are often high, and may be arbitrarily fixed, depending upon who you are and your perceived ability to pay.  Cobb & Cobb does not believe in arbitrary billing - we charge $75.00 per hour forall civil and criminal appellate work, plus filing fees.  To qualify for these rates, all we ask is that our clients pay us for twenty hours in advance ($1,500), plus the filing fees (usually around $500).  You will receive periodic invoices showing you what we have been doing on your case, and when we have used up your initial payment (retainer), we will require an additional deposit for ongoing or future work.  The final cost of each appeal will vary, but with Cobb & Cobb you can be assured that you are getting the very best legal representation at an excellent price.
